Formula & methodology

How California Overtime & Double-Time Rules Work

Under California Labor Code Section 510, non-exempt employees earn overtime based on both daily and weekly thresholds:

  • 1.5× Overtime: Hours worked over 8 up to 12 in a single workday, hours over 40 straight-time hours in a workweek, and the first 8 hours worked on the 7th consecutive workday in a workweek.
  • 2.0× Double Time: Hours worked beyond 12 in a single workday, and any hours worked beyond 8 on the 7th consecutive workday in a workweek.

Common questions

Frequently Asked Questions

Does California require daily overtime after 8 hours?

Yes. Even if an employee works fewer than 40 hours in the week, any hours over 8 up to 12 in a single workday must be paid at 1.5x their regular rate.

When does double time start in California?

Double time (2x the regular rate) applies to all hours worked past 12 hours in a single workday, and all hours worked past 8 hours on the seventh consecutive day of work in a workweek.

Are daily overtime hours counted twice toward the 40-hour weekly threshold?

No. California prohibits pyramiding overtime—only regular (straight-time) hours count toward the 40-hour weekly overtime threshold.
